On Monday, the Supreme Court overturned a Colorado court decision that blocked Donald Trump from being listed on the state’s Republican presidential primary ballot due to a provision in the U.S. Constitution concerning individuals involved in “insurrection”.
The Supreme Court’s unanimous ruling in favor of Trump was expected and ensures that votes cast for him on Tuesday’s ballot will be valid, allowing the former president to participate in the primary.
In December, the Colorado Supreme Court made a decision to prevent Trump from appearing on the 2024 ballot. All seven justices on the court, who were appointed by Democrats, participated in the ruling.
Three of these justices dissented from the majority opinion.
The legal basis for this decision stems from Section 3 of the 14th Amendment of the US Constitution, which allows for the disqualification of public officials who have been involved in insurrection or rebellion against the United States.
It’s important to note that Trump has not faced any charges related to such activities.
The oral arguments regarding Trump’s eligibility for the ballot concluded in early February, during which Colorado lawyer Jason Murray presented his case before the Supreme Court.
Even the more liberal-leaning justices expressed doubts and skepticism during these proceedings.
